If you want the same for texexec, then make this -8bit available via
setting in your config file (context/config/texexec.ini). People who have
a new engine can make use of the new option. teTeX's and TL's version
of this config file can ship with the new configuration.
If you want to support old binaries as well and if you don't want to
rely on fmtutil, you have to provide both ways for creating the formats.
If you don't want that the user has to set an option for this, you have
to detect the engine yourself (e.g. parse "pdfetex --help").

In no way. MikTeX has its own implementation of TeX.
