Yes the \upshape is unnecessary. The items are set in group anyway,
so there is no need to revert the \itshape.

No, 12bp is simply wrong as document option. To get a 12pt font one
has to use 12pt as option. 12bp is ignored and leads to a 10pt font
in the document.
